1. Acceptance of Terms

By accessing or using Pepper ("Service") at mypepper.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Pepper is provided by Fieldcrest Ventures LLC ("Company," "we," "our," or "us").

2. Description of Service

Pepper is an AI-powered executive assistant that:

  • Triages and classifies your email by importance
  • Generates draft responses in your communication style
  • Coordinates meeting scheduling and calendar management
  • Automates routine email tasks with your approval
  • Learns your preferences through progressive trust

The Service integrates with:

  • Gmail (for email management)
  • Google Calendar (for scheduling)
  • Anthropic Claude (for AI processing)
  • Voyage AI (for semantic embeddings)

3. Eligibility

You must be at least 13 years old to use Pepper. By using the Service, you represent and warrant that:

  • You are at least 13 years old
  • You have the right, authority, and capacity to enter into these Terms
  • You will comply with all applicable laws and regulations

4. Account Registration

4.1 Google OAuth

To use Pepper, you must authenticate with your Google account. By connecting your Google account, you authorize Pepper to access:

  • Gmail (read messages, send on your behalf, modify labels)
  • Google Calendar (read, create, modify events)
  • Profile information (email, name, picture)

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

We will never ask for your Google password. All authentication is handled securely through Google OAuth.

4.3 Account Termination

You may terminate your account at any time by:

  1. Going to Settings → Account → Delete Account
  2. Confirming deletion

Upon termination, we will delete your data within 30 days as described in our Privacy Policy.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use Pepper to:

  • Manage your personal or business email
  • Schedule meetings and appointments
  • Automate routine email tasks
  • Learn productivity patterns

5.2 Prohibited Uses

You may NOT use Pepper to:

  • Send spam, unsolicited bulk email, or phishing attempts
  • Harass, threaten, or abuse others
  • Violate any laws or regulations
  • Impersonate another person or entity
  • Distribute malware, viruses, or harmful code
  • Bypass or circumvent our security measures
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service for competitive analysis or to build a competing product
  • Exceed usage limits for your tier
  • Automate actions in ways that circumvent safety controls

5.3 Content Restrictions

You are solely responsible for all content you send through Pepper. You may not use Pepper to send:

  • Illegal content (child exploitation, terrorism, illegal drugs)
  • Infringing content (copyright, trademark, trade secret violations)
  • Malicious content (malware, viruses, phishing)
  • Hateful content (harassment, threats, hate speech)

6. Career Ladder System

6.1 Trust Tiers

Pepper operates within tiers that represent increasing levels of autonomy. As you use Pepper and approve its suggestions, you "promote" Pepper to higher tiers, unlocking more capabilities:

6.2 Trust Progression

  • New users start at L0 (Intern)
  • Progression to higher levels requires demonstrated approval patterns
  • You can manually adjust your tier at any time
  • Pepper may automatically reduce tier if error rates increase

6.3 Decision Cards

All suggested actions are presented as Decision Cards with:

  • Clear description of proposed action
  • Countdown timer (configurable, default 60 seconds)
  • One-tap approve/reject controls
  • "Pepper was wrong" feedback option

6.4 SafetyGate

Certain actions always require explicit approval regardless of tier:

  • Actions involving financial commitments
  • Actions involving VIP contacts you designate
  • Actions with potential legal implications
  • Bulk operations affecting multiple recipients

7. Service Limitations and Availability

7.1 Service Status

Pepper is a live service. We strive to maintain high uptime and reliability. The Service is provided "AS IS" and may occasionally contain bugs or performance issues as we continuously improve.

7.2 Usage Limits by Tier

Exceeding limits may result in temporary feature restrictions until the next billing cycle.

7.3 Google API

Pepper integrates with Google APIs to access your email and calendar. Usage is subject to Google's Terms of Service and quotas.

8. Pricing

8.1 Tier Pricing

Pepper offers five tiers:

  • Intern: Free (500 emails/50 AI actions per month)
  • Assistant: $49/month (2,000 emails/500 AI actions)
  • Executive Assistant: $99/month (10,000 emails/2,000 AI actions)
  • Senior EA: $199/month (Unlimited emails/5,000 AI actions)
  • Chief of Staff: $299/month (Unlimited everything)

8.2 Annual Discount

All paid tiers offer a 20% discount when billed annually instead of monthly.

8.3 Founding 100 Pricing

Our first 100 paid users receive early adopter pricing, locked in for their first 12 months. After reaching 100 paid users, new signups will use standard tier pricing. Founding users will renew at standard rates after their first year.

8.4 Free Trial

All new accounts receive a 14-day free trial of Executive Assistant tier capabilities. No credit card required.

9. Intellectual Property

9.1 Our Rights

Pepper, including all software, algorithms, designs, and content, is owned by Fieldcrest Ventures LLC and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or create derivative works
  • Distribute, sell, or sublicense the Service
  • Remove or alter any proprietary notices

9.2 Your Content

You retain all rights to your email content, drafts, and data. By using Pepper, you grant us a limited license to:

  • Process your content to provide the Service
  • Use aggregated, anonymized data to improve the Service
  • Display your content back to you in the interface

This license terminates when you delete your account.

9.3 AI-Generated Content

Drafts generated by Pepper's AI are provided for your review and approval. You are responsible for reviewing all AI-generated content before sending. We do not claim ownership of AI-generated drafts you approve and send.

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Key points:

  • Email bodies are fetched on-demand, not permanently stored
  • We use Anthropic Claude for AI processing
  • We never sell your data
  • You can export or delete your data anytime
  • We comply with Google API Services User Data Policy

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including:

  • Merchantability – No guarantee the Service meets your requirements
  • Fitness for a particular purpose – May not be suitable for your specific needs
  • Non-infringement – No guarantee against IP claims
  • Accuracy – AI-generated content may contain errors
  • Reliability – Service may be unavailable or slow
  • Data integrity – Data may be lost or corrupted

IMPORTANT: AI-generated drafts may contain factual errors, hallucinations, or inappropriate content. You must review all drafts before sending. We are not responsible for emails sent without proper review.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELDCREST VENTURES LLC SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Lost profits, revenue, data, or business opportunities
  • Damage to reputation or relationships
  • AI errors, miscommunication, or missed opportunities

MAXIMUM LIABILITY:

Our total liability shall not exceed the greater of: $100 USD, or amounts you paid us in the last 12 months.

12.1 AI-Specific Disclaimers

Pepper uses AI (Claude) to generate drafts. AI systems:

  • May hallucinate – Generate plausible-sounding but incorrect information
  • May misinterpret context – Misunderstand tone, urgency, or intent
  • May make mistakes – Factual errors, grammatical issues, or inappropriate suggestions

YOU ARE RESPONSIBLE for reviewing and approving all AI-generated content before sending.

13. Indemnification

You agree to indemnify and hold harmless Fieldcrest Ventures LLC from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any laws or third-party rights
  • Content you send through Pepper
  • AI-generated content you approve and send

14. Modifications to Terms

We may modify these Terms at any time. If we make material changes, we will notify you by:

  • Posting the updated Terms with a new "Last Updated" date
  • Sending an email notification
  • Displaying a notice in the Service

Continued use after changes constitutes acceptance.

15. Termination

15.1 Termination by You

You may terminate your account at any time as described in Section 4.3.

15.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • Your account is used for illegal activity
  • We are required by law
  • We discontinue the Service (with 30 days notice)

15.3 Effect of Termination

Upon termination:

  • Your access will be revoked
  • Your data will be deleted within 30 days
  • Sections 9, 11, 12, and 13 survive termination

16. Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States.

16.2 Informal Resolution

Before filing a lawsuit, you agree to attempt informal resolution by contacting support@mypepper.io. We will work in good faith to resolve disputes within 30 days.

16.3 Arbitration

If informal resolution fails, disputes shall be resolved by binding arbitration under AAA rules. Arbitration will be conducted in Delaware.

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND CLASS ACTIONS.

16.4 Exceptions

Small claims (under $10,000), IP disputes, and injunctive relief may be filed in court.

17. Miscellaneous

  • Entire Agreement – These Terms and our Privacy Policy constitute the entire agreement
  • Severability – Invalid provisions do not affect remaining terms
  • No Waiver – Failure to enforce doesn't waive rights
  • Assignment – You may not assign; we may assign to successors
  • Force Majeure – Not liable for events beyond reasonable control
